1. Acceptance
By accessing or using the Vita Health 365 website (vitahealth365.com) or any services offered through it, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our website or services. These Terms form a binding agreement between you and Vita Health 365, a California medical practice.
2. Eligibility
To use our services, you must be:
- At least 18 years of age.
- A resident of the state of California, or physically located in California at the time of any telehealth visit.
- Able to provide accurate identification and health information as required by law.
If you are under 18, a parent or legal guardian must create an account and consent on your behalf where applicable.
3. Services overview
Vita Health 365 is a California medical practice offering telehealth consultations, remote therapeutic monitoring (RTM), nutrition coaching, weight-management programs, and select regenerative procedures. Services are provided by licensed physicians (MD) and nurse practitioners (NP) credentialed in the state of California.
Not all services are available to all patients. Your provider will determine which services are appropriate for you based on clinical evaluation.
4. Accounts & registration
Some features require you to create an account. When you register, you agree to:
- Provide truthful, accurate, and complete information.
- Keep your login credentials private. You are responsible for all activity under your account.
- Notify us right away if you believe your account has been accessed without your permission.
We may suspend or close accounts that violate these Terms or that remain inactive for an extended period.
5. Telehealth limitations
Our telehealth services are not a replacement for emergency care. If you are experiencing a medical emergency, call 911 immediately.
- Telehealth visits require that you are physically located in California at the time of the visit. This is required by California law.
- Some conditions cannot be fully evaluated or treated through telehealth. Your provider may refer you to in-person care when needed.
- Telehealth relies on technology. Connection issues, audio or video problems, or device failures may interrupt your visit. We are not responsible for disruptions caused by your equipment or internet service.
6. Payments & refunds
Vita Health 365 operates on a self-pay model. We do not bill insurance directly. You are responsible for the full cost of services at the time of booking or visit.
- We accept major credit cards, debit cards, and payment through FSA (Flexible Spending Account) and HSA (Health Savings Account) cards.
- Pricing is listed on our website and confirmed before each visit. We will not charge you more than the agreed amount without your consent.
- Refund requests must be submitted within 14 days of service. Refunds are reviewed on a case-by-case basis. We may issue a full or partial refund depending on the situation.
- Missed appointments without at least 24 hours' notice may be subject to a cancellation fee.
7. Intellectual property
All content on our website, including text, images, logos, graphics, and software, is the property of Vita Health 365 or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may view, download, and print pages for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from our content without written permission.
8. User conduct
When using our website and services, you agree not to:
- Provide false identity or health information.
- Use the services for any unlawful purpose.
- Attempt to gain unauthorized access to our systems, patient data, or other users' accounts.
- Interfere with the functioning of our website or services.
- Harass, threaten, or abuse our staff, providers, or other users.
- Use automated tools (bots, scrapers) to access our website without permission.
9. Disclaimers
Our services are provided for general health and wellness purposes. While we employ licensed medical professionals, our telehealth services are not a substitute for in-person medical care in all situations. Your provider will tell you if in-person care is needed.
- We do not guarantee specific health outcomes.
- Information on our website is for educational purposes and does not constitute medical advice until you are in a provider-patient relationship.
- Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied.
10. Limitation of liability
To the fullest extent allowed by California law, Vita Health 365 and its officers, employees, and providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of data, loss of revenue, or interruption of service.
Our total liability for any claim related to these Terms or our services shall not exceed the amount you paid to us in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under California law.
11. Dispute resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. California law governs all disputes arising from these Terms or your use of our services.
Before filing a lawsuit, you agree to try to resolve the dispute informally by contacting us at hello@vitahealth365.com. If we cannot resolve the dispute within 30 days, either party may bring a claim in the state or federal courts located in Los Angeles County, California. You consent to the jurisdiction of those courts.
12. Modifications
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last Updated" date. We will provide at least 14 days' notice before material changes take effect. Your continued use of our services after changes take effect means you accept the updated Terms.
13. Severability
If any part of these Terms is found to be unenforceable or invalid by a court, that part will be enforced to the maximum extent allowed by law, and the remaining parts will continue in full force and effect.
