Vita Digital Wellness — Supplementary Terms & Liability Disclaimer Effective: 2026-05-15 / Version: 1.0 This document supplements the Vita Health 365 General Terms of Use and applies to the AI-powered fitness, nutrition, recovery, sleep, and mental wellness coaching services provided by "Vita Digital Wellness" (hereinafter "the Service"). Section 1. Nature of the Service 1.1 The Service does NOT constitute medical practice and does NOT provide medical diagnosis, prescription, or treatment. 1.2 All exercise programs, dietary recommendations, recovery guidance, and other suggestions are general health information and shall NOT replace evaluation or prescription by a qualified medical professional. 1.3 Responses generated by the Service may include outputs from artificial intelligence (Large Language Models), which may be inaccurate or inappropriate for the user's specific situation. Section 2. User Obligations and Acknowledgments 2.1 Users in any of the following categories MUST consult a licensed physician BEFORE using the Service: a) Cardiovascular disease, hypertension, diabetes, asthma, or other chronic conditions b) Pregnancy, lactation, or within 6 months postpartum c) Surgery within the past 6 months d) History of chest pain, dizziness, or shortness of breath during physical activity e) Under 18 or over 65 years of age 2.2 If pain, injury, dizziness, shortness of breath, or other abnormal symptoms occur during use of the Service, the user MUST immediately cease activity and seek medical care. 2.3 The user agrees to evaluate and act on all recommendations AT THEIR OWN RISK. Section 3. Limitation of Liability 3.1 The Company shall NOT be liable for any physical or mental harm, injury, or aggravation of disease arising from the user's actions based on information provided by the Service, except in cases of willful misconduct or gross negligence by the Company. 3.2 The Company makes NO warranty as to the accuracy, suitability, or completeness of AI-generated responses, and such responses MUST NOT be used as the sole basis for clinical or legal decisions. 3.3 The Service does NOT respond to medical emergencies. In emergencies, contact your local emergency number immediately. Section 4. Personal Information and Health Data 4.1 The Service collects and processes user information related to fitness, nutrition, sleep, and mental wellness in accordance with the Vita Health 365 Privacy Policy. 4.2 User identifiers are anonymized when calling external AI models, and data sent to external model providers is NOT used for model training. 4.3 The user may terminate use of the Service and request deletion of related data at any time. Section 5. Payment and Automatic Conversion 5.1 The Service is offered with a complimentary free tier of cumulative AI usage per user, the amount of which is determined and disclosed by Vita Health 365 from time to time. 5.2 Upon reaching the free tier limit, the user will receive prior notice; if the user consents to paid conversion (checkbox + payment information entry), a monthly subscription will commence ($9.99/month, $5.99/month with promotional discount). 5.3 No payment will occur without the user's explicit consent; additional AI responses will be restricted after the free limit is exceeded if consent is not given. 5.4 The subscription auto-renews monthly; the user may cancel at any time from the billing page. Section 6. Dispute Resolution 6.1 Disputes related to these Terms shall be resolved under the laws of the State of California, United States, with exclusive first-instance jurisdiction at the courts located in the principal place of business of Vita Health 365.
